原則上我反對代理孕母這樣的制度，我自己絕不願意為別人代孕，也不會想要利用另外一個女人的身體來滿足我自己的願望。但若別的女人，雙方有深厚的情誼，基於某些特殊的理由，或許我無法理解，願意代為承受懷孕的風險，（不是有為朋友兩肋插刀的說法嗎？）我也不會跳出來阻止。但我反對無限擴張至要求陌生女子基於利他的動機、不收受報酬為自己懷孕、生育。政府更不應以公權力來保障對女人身體的占用。
若衛福部和立法院執意以修改人工生殖法局部條文來合化法代孕，我希望至少對代孕者和因代孕而出生的生命給予足夠的尊重和保護，不要草率行事。以下對衛福部送交性平會的修法草案提出建議及疑問：
a. The doctor who carried out the procedure that resulted in the birth of the relevant child; or
b. The institution where the procedure was carried out; or
c. Another entity involved in carrying out the procedure.）
（澳Western Australia: 生母及其伴侶、arranged parents及其伴侶、捐贈者及其伴侶都需接受諮商及獨立的法律建議(advice)）
a. Any payment is at any time received by himself or another in respect of it, or
b. He does it with a view to any payment being received by himself or another in respect of making, or negotiating or facilitating the making of, any surrogacy arrangement.
代孕者除外。
仲介機構：a payment received by a person connected with a body is to be treated as received by the body）
（澳：訂立商業代孕合約或仲介商業代孕合約，一年以下或併罰100units（144.34澳幣為1 unit））
a. Publishes an advertisement, notice or anything else with the intention of inducing someone to enter into a substitute parent agreement; or
b. Publishes an advertisement, notice or anything else that—
i. Is likely to induce someone to enter into a substitute parent agreement; or
ii.seeks or purports to seek someone who is willing to enter into a substitute parent agreement; or
iii. states on implies that someone is willing to enter into a substitute parent agreement.
50 penalty units--+6 months）
（澳何謂出版Publish—if
a. included in a newspaper, periodical publication or other publications; or
b. publicly exhibited in, on, over or under a building, vehicle or place (whether or not a public place and whether on land or water), or in the air in view of people on a street or in a public place; or
c. contained in a document given to someone or left on premises where someone lives or works; or
d. broadcast by radio or television; or
e. electronically disseminated in another way (for example, by inclusion on a website)
Note An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears.）

五．代孕子女的權利（第二十九條）

一．有關委託（受術）夫妻及精卵捐贈人（第七條）
1.
委託（受術）夫妻之檢查及評估應增加有無犯罪（特別是性犯罪）、家暴之紀錄，並確保雙方之年齡／健康狀況足以照顧代孕子女至成年。
(西澳：因年長而無法懷孕不能做為委託代孕之理由；荷蘭：委託之妻不得大於41歲；以色列：委託夫不得大於59歲，妻不得大於48歲)
2.
在台設籍並居住半年以上，（方得享用健保。）
（澳、以規定委托者必須為當地居民）
3. 委託夫妻及捐贈人檢查及評估：（二）家族疾病史，包括四親等內血親之遺傳性疾病紀錄。如何從外國捐贈者取得此資訊？本國人沒困難？
二．心理、生理及法律諮商（十二條之一）
應明確規定精卵捐贈者、委託者、代孕者及其配偶或伴侶都需接受獨立的心理、生理及法律諮商，以確保各方都獲得完整、正確的資訊，再做決定。獨立是指與進行代孕的醫師和機構沒有任何關聯。
（澳ACT領養代孕子女:
both birth and substitute parents have received appropriate counselling and
assessment from an independent counseling service）

三．不得仲介及明訂罰則（十二條之二）
居間代孕服務機構定義不明，應明訂個人和機構皆不得進行仲介，不得收取任何形式報酬。居間代孕服務機構內之個人收取報酬視同機構收取報酬。

五．代孕子女的權利（第二十九條）
代孕子女知的權利不應加以限制，自己及子孫有權知道家族基因史，誰來保存代孕資料50年？
六．血統真實主義
需要三個女人一起努力、吃苦，才能讓一個男人傳宗接代，結果只採認男人的血統，這叫血統真實主義？誰的真實？
真要談血統，應是捐卵者和精子所有人的血統，而非精子所有人和其配偶的血統。子女有權了解自己真正的血統和基因身分。
七．收養、准收養及反悔權
大部分合法化代孕的國家，包括英、澳、荷、加、以，都尊重孕育生命的辛勞、神聖，視代孕者為生母(birth parent)及法律上的母親，（以色列則是由社工暫任監護人，澳洲甚至在法律上稱委託者為substitute
parent或 arranged parent,)委託者皆需經過收養或准收養手續。五國都給予孕母反悔權。反悔權其實甚少有人使用，但其存在可以確保代孕者確實是在自由意志下放棄對子女的親權。委託夫妻並未支付報酬，那麼他們希望擁有子女的慾望，不應認為一定比代孕者具有優先性，我們不要忘了承受懷孕風險的是代孕者。
應保存敬母的優良傳統至少給予代理孕母反悔權。
