email: yenlinku@mail2000.com.tw

For Whom Is Taiwan’s Gender Policy? ---- Preparing for the Fifth CEDAW Report

Yenlin Ku

In July 2025, the Executive Yuan held a civil society consultation in preparation for the fifth national report on the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), due for submission next year. The terms used in the report expanded beyond women to include gender, transgender women, LGBTI+, plural genders, sex and gender, gender-friendly, among others. A notable issue was the lack of definitions for these terms. These concepts and terms, absent from the original CEDAW, were introduced without explanation of their relevance to the Convention’s primary focus: women. For years, civil society groups have asked for definitions of "gender" and "plural genders." Again, the organizers of the consultation did not address the questions directly. They just implied that such terms could be found in the General Recommendations of CEDAW.

The Directorate-General of Personnel Administration declared 2012 as the "Year of Gender Equality" in an effort to “align with international standards.” This initiative marked a shift in official terminology from “women” to "gender" in policy documents and ignited subsequent renaming of women's rights promotion commissions to gender equality commissions. In 2020, the Executive Yuan's Department of Gender Equality issued a directive in the form of a bilingual terminology chart mandating that the Chinese term "性別" (which can mean either gender or sex) be translated as "gender" in English, effectively excluding the use of "sex."  This decision was likely a response to concerns raised by international reviewers in the third CEDAW report regarding the ambiguous use of terminology by the government. Over the past decades, the contentious KMT and the DPP administrations both adopted the term “plural genders” (多元性別), but refrained from providing a formal definition. The motivation poses an interesting avenue for further research.

How important and relevant is the concept of gender in public policy? Many people may dismiss it a trivial matter. However, since the 20th century, a growing number of laws and policies have been enacted to regulate public and private life through the lens of gender. These policies impact interactions between individuals and institutions, compelling states and employers, for instance, to eliminate gender discrimination under agreements like CEDAW. Given that gender is now deeply intertwined with both public and private life, and that the government voluntarily takes up high-profile, quadrennial reviews of Taiwan’s gender policies with their invited international experts, shouldn’t the terminology and meanings used in the national report and related laws be sufficiently clear and consistent? After all, clarity and consistency are crucial for fostering productive discussion, building consensus, and enabling citizens to adjust their behavior and hold each other accountable under these laws?

This raises another question: Is it reasonable to require citizens to rely on external interpretations—like CEDAW’s general recommendations --without thorough public discussion or explanation of new and unfamiliar concepts and regulations? As the Executive Yuan is working on its draft for the Anti-Discrimination Law, it remains to be seen whether the handling of gender terminology will continue to be vague and ambiguous without informing the general public.

(https://gec.ey.gov.tw/Page/9AF497D56C5C34BC)

男女的定義則分別是「所有年齡的人類男性」(human male of all ages) 及「所有年齡的人類女性」(human female of all ages),sex則是指生理特徵。

(My suggestions to the fifth National CEDAW Report)

男女的定義則是human male of all ages 及human female of all ages,對於跨男的保護更為具體而實際。

從gender 到 sex –-- 美國性別政策的轉移 ( From "gender" to "sex"--- The transition of US Policy)

Equity or Equality?

What I Did and Didn’t Do on Inauguration Weekend by Jo Freeman

What I Did and Didn’t Do on Inauguration Weekend

                                                         by Jo Freeman

The long weekend is finally over.  There was big news all over the world. I’m not going to tell you about the events you could read about easily. I’m going to write about the ones I went to which got very little media coverage, nationally or locally.

I took the bus to DC last week in order to attend the People’s March, aka the Women’s March.  There have been many such marches since the first one on January 21, 2017 – the day after Trump’s first inauguration.  That day, so many women converged on Pennsylvania Ave. and the Mall that no one could count them.   Indeed, you could barely move, let alone march.   Last Saturday, there were roughly a hundred thousand people marching in DC from three national parks north of the White House to the Lincoln Memorial.  It was one of several marches around the country.

2 Books on Gender: Material Girls and On Sex and Gender

Material Girls:Why Reality Matters for Feminism   2021

On Sex and Gender: A Commonsense Approach

Coleman

On the Equator -- Wu's novel

Wu was my husband's buddy from high school and a highly achieved scientist and engineer with broad interests in arts, history and literature. He died from lung cancer at an early age of 64 and left behind an unpublished novel On the Equator. It is a heart-breaking love story between a Taiwanese comfort woman and a Taiwanese military doctor in the Japanese army during the Second World Warand a legacy of Wu's creative talent and humanitarian sentiments.

Yenlin Ku

In my mind, 嘉林's work possesses many elements that have the potential of developing into a full-fledged novel or even a masterpiece. As mentioned previously, it has a well-built, balanced structure. Literary symbols have been put to good use. The many ironies and paradoxes in the story make the plot intriguing to the point of being bewildering. It is exactly the bewilderment, the puzzling nature of life that captivates the reader and provokes her/him to think.

In the writer's scheme, I believe, Mei Chun has to die in the end. For many reasons, Mei and Chen's love was strictly prohibited despite their mutual attraction. It only became possible when, for a short period of time, all the ruling forces were pulled out and Chen became the temporary ruler of the emptied military camp. Mei put on a pretty dress and loved Chen as an equal.  That chapter is named "Paradise" not without reason.

Ironically, their love is doomed from the very beginning because it will find no blessing outside the temporary and, in fact, illusionary paradise. Returning to Chen's home together would perhaps be the beginning of more tragedies for Mei. Building a life in defeated Japan with the crippled schizophrenic captain would be equally humiliating for Mei as an ex-comfort woman. To survive in either place would mean surrendering her dignity.

A brave and smart young woman sold into slavery by her close relative, Mei first tried to protect her dignity by going on a hunger strike when the nursing job she expected turned out to be prostituting. Then refusing to return to prostitution after she had a chance to work as the doctor's assistant, she threatened to kill herself with a knife. In a worn military uniform, she worked harder than any man in the effort of saving lives and won herself respect.  Mei survived hell but was cheated by the illusions of paradise.

Desperate love for a undeserving man has taken the lives of many literary heroines: Madame Bovary, Anna Karonina and Madame Butterfly, to name the best-known few. Chen, the well-educated gynecologist, set his mind on returning home to resume his business and family life, which included an imagined son. Absent-minded, he failed to notice Mei's symptoms of pregnancy and rudely brushed away her appeal for not leaving the island (abandoning the paradise). In contrast, Chen's assistant, the aboriginal fisherman, less-educated but enjoying more freedom in life, was much more caring and sensitive. He discovered Mei's embarrassing pregnancy and felt for her. Furthermore, he made the choice of staying on the island to build a family with a local woman who happened to be pregnant at the same time.

Mei did not want to die. But she had no "lakes and rivers" to return to when the paradise was lost.

Fate did not offer Mei many choices (in the setting of the mid-20th century), did it?

(And that is why we needed a feminist revolution. For your information, this last statement is made over the objection of Pei-yuan, my husband. And it proves that the movement still has a long way to go.)

(Elderly Care Policy in Super-aged Taiwan)
